Nearly 39,000 women in US had sued Bayer over use of Essure™, a Fallopian tube implant that prevents pregnancies. Essure™ caused serious health complications including the perforation of the uterus and Fallopian tube, abdominal pain, menstrual issue, miscarriage, and unintended pregnancy.
Aug 20, 2020, Bayer has agreed to pay $1.6 billion to resolve around 90% of these claims. The deal includes litigation consolidated in California as well as in federal court in Pennsylvania.
2013, Bayer bought the Silicon Valley start-up Conceptus Inc., which created the Essure™ devices, for $1.2 billion, nearly 11 years after the US FDA approved the product. However, in 2015, an FDA safety panel after receiving multiple complaints, weighed the risks and recommended "black box" warnings on the device. Later in 2018, Bayer voluntarily stopped selling the device.
With these settlements, Bayer resolves practically all the US Essure™ litigation. However, these U.S. settlements have no impact on pending litigation in other countries.
